A nurse sued by the parents of a disabled 19 year-old who they believe was allowed to drown in his own mucus while heading home from his special needs school was criminally charged Thursday for allegedly failing to respond to the medical crisis that ultimately ended in the young man’s death.

The family’s attorney, Paul M. da Costa of Snyder Sarno D’Aniello Maceri & da Costa of Roseland, said following the release of the complaint his clients were satisfied that the criminal justice system was pursuing justice on behalf of their son.

“But on the eve of his 20th birthday, this is not where their path to true justices ends,” said da Costa. “Matthew’s voice will be heard through the justice system and his parents are fully dedicated to righting the wrongs that were bestowed upon their beloved son.”

He said the Rossi family “intended to do everything in their power to make sure something like this does not ever happen again and will be advocating for the passage of new laws in the Legislature regarding mandatory monitoring on buses with disabled individuals like Matthew.”
