Paul M. da Costa and Mitchell A. Dornfeld Secure $900,000 Settlement in Commercial Motor Vehicle Accident

Congratulations to Partner, Paul M. da Costa, and Associate, Mitchell A. Dornfeld, who secured a $900,000.00 settlement on behalf of a 54-year-old Passaic County man injured in a rear-end commercial motor vehicle crash on Route 3 East in Clifton, New Jersey.  

As a result of the crash, the plaintiff sustained serious and permanent right shoulder, neck, and low back injuries. He underwent a right shoulder arthroscopy which was heavily disputed by the defense as being caused by the crash since the right shoulder MRI showed impingement and arthritic changes but no acute tears. In addition, the plaintiff underwent a 2-level anterior cervical and discectomy and fusion more than 3 years following the crash. Given the significant length of time the plaintiff had neck surgery after the crash and the fact that he had chiropractic treatment for the neck more than ten years before the crash, the defense also contended that the neck injuries and resultant surgery were not causally related to the motor vehicle crash.
