Dennis Shlionsky Secures $550,000 Settlement in Tractor Trailer Accident

Congratulations to Associate, Dennis Shlionsky, who secured a $550,000 settlement for a 55-year-old Bergen County woman injured on the Cross Bronx Expressway, when a tractor trailer side side-swiped her sedan.  As a result, the woman exacerbated spinal and knee injuries for which she underwent an L5-S1 fusion surgery.  

Amongst several other causes of action, Mr. Shlionsky brought negligent hiring, supervision, training, and retention claims against several trucking companies, which disputed liability and coverage through the case.  The defense maintained chronic back problems for which our client had been treating and using a walking cane prior to the collision.  Several defense insurance companies disclaimed liability coverage for inactive and inapplicable policies.  

Mr. Shlionsky argued that the MCS-90 Endorsements have routinely been used to overcome cancelled and inactive insurance policies. After a hard-fought coverage dispute, Progressive Insurance paid its limits of  $300,000, and two inactive motor carrier policies paid a combined $250,000 (Progressive and United National) totaling $550,000.
